Article 1. Person concerned and shoot
The signed form states:
- the surname, first name, e-mail address and, for a minor, the date of birth of the person photographed, filmed or recorded (the "Person");
- the date, place and event of the shoot, its purpose (interview, portrait, report, branded content shoot or other) and the name of the photographer or videographer.
Article 2. Scope of the authorisation
The Person authorises FLM, free of charge, to photograph, film and record them during the shoot described in Article 1, and to reproduce, communicate to the public, adapt and distribute their image, voice, first name and statements, as well as the photographs, videos and recordings resulting from it (the "Content").
This authorisation applies:
- on all media, known or unknown to date, including websites, applications, newsletters, social networks, the press, television, billboards, printed materials, events and trade shows;
- for all uses, including editorial, institutional, promotional, commercial and advertising uses, including in association with brands, products or services;
- for all adaptations, including cropping, retouching, editing, cutting, subtitling, translation and inclusion in other content, without distorting the Person's statements;
- worldwide, for a period of ten years from the shoot. Upon expiry of this period, Content published during it may remain online and in archives, without any new use.
Article 3. Beneficiaries of the rights
FLM may use the Content on its own media and on those of Finishers SAS and any company of its group. It may assign or license all or part of the rights set out in Article 2, free of charge or for consideration, to any third party of its choice, including event organisers, their partners and sponsors, brands, agencies and media, for their own communications, including advertising.
Article 4. Limits
The Content is never used in a way that harms the Person's dignity, privacy or reputation.
The Person's surname is only mentioned if they have agreed to it by ticking the box provided on the form. Otherwise, only their first name may be mentioned.
This authorisation is optional. Refusing it has no consequence on the Person's participation in the event.
Article 5. No remuneration
The Person acknowledges that this authorisation is granted free of charge and that they may not claim any remuneration or consideration for the use of the Content, whatever the uses made of it.
Article 6. Minors
For a minor, the authorisation is signed by both holders of parental authority, or by one of them declaring that they act with the other's agreement. The minor is involved in the decision according to their age and maturity. From the age of thirteen, the minor also signs the form.
Article 7. Personal data
FLM processes the data on the form (identity, contact details, signature) and the Content in order to evidence the authorisation and use the Content, on the basis of this contract. This data is kept for the duration of the authorisation, then for five years as evidence. The Person's contact details are never published, and are only disclosed to the third parties mentioned in Article 3 where necessary to evidence the authorisation.
The Person has a right of access, rectification, erasure, restriction and objection regarding their data, which they may exercise at privacy@finishers.com. Exercising these rights does not affect the use of Content already published. They may also lodge a complaint with the CNIL (www.cnil.fr), the French data protection authority.
Article 8. Governing law
This authorisation is governed by French law. The French version prevails.
